1.3.2 take any responsibility or accept any liability for any information provided or posted on the Website, whether by GearLog, Participants, or for any advice, assistance or other services given or received by Participants, Companies or any other parties.

GearLog leverages Agile Software Development practices to iterate on and improve the Website and Website Content and Services based on feedback from the user community. In addition, GearLog may stop (permanently or temporarily) providing the Website (or any features within the Website) to you or all general users and may not be able to communicate to you with advanced notice.

If you become a Participant, you acknowledge and agree that:
3.1.1 under no circumstances will you utilise the Website to provide, or facilitate the provision of, advice or any other services to any third party in return for any form of financial reward, commercial gain or similar benefit;
3.1.2 GearLog excludes and disclaims all liability in accordance with Clauses 12 and 14 below;
4 - Payment and Payment Information
4.1
If you purchase any services that we offer for a fee, either on a one-time or subscription basis ("Premium Services"), you agree to GearLog storing your payment information. You also agree to pay the applicable fees for the Premium Services (including, without limitation, periodic fees for premium accounts) as they become due plus all related taxes, and to reimburse us for all collection costs and interest for any overdue amounts. Failure to pay may result in the termination of your subscription. Depending on where you transact with us, the type of payment method used and where your payment method was issued, your transaction with us may be subject to foreign exchange fees or differences in prices, including because of exchange rates.
4.2
GearLog does not support all payment methods, currencies or locations for payment. If the payment method you use with us, such as a credit card, reaches its expiration date and you do not edit your payment method information or cancel your account or such Premium Service, you authorize us to continue billing that payment method and you remain responsible for any uncollected amounts. Your obligation to pay fees continues through the end of the subscription period during which you cancel your subscription. All applicable taxes are calculated based on the billing information you provide us at the time of purchase.

If you require an explanation of GearLog's refund policy please e-mail info@gearlog.org We do not guarantee refunds for lack of usage or dissatisfaction. You also acknowledge that GearLogĂs Premium Services are subject to these Terms and Conditions and any additional terms related to the provision of the Premium Service.
5 - Account Registration
5.1
To use some of the functions of this Website, you must register and create an account (a "User Account"). In doing so, you agree:
5.1.1 to provide accurate, current and complete information about yourself as prompted by the registration form on the Website ("Registration Data");
5.1.2 to maintain the security of your User Account login details and password;
5.1.3 to maintain and promptly update the Registration Data, and any other information provided by you to
GearLog, and keep them accurate, current and complete;
5.1.4 that you are fully responsible for all use of your User Account and for any actions that take place using your User Account; and

6.1

GearLog may take any action with respect to any advice, communications, information or other services of a User that GearLog deems necessary or appropriate in its sole discretion.
8.3
You consent to GearLog identifying you as a Customer of GearLog (including by using your organisation name and trade marks) in GearLog's promotional and marketing materials.
9 - Third Party Content, Software and Links

Where content, information, software, advertising and any other material or services are supplied by third parties, you acknowledge and agree that GearLog cannot control and does not purport to endorse such third party content in any way. You agree that Participant and Companies shall be entitled to the benefit of the provisions of this Clause 10 under the Contracts (Rights of Third Parties) Act 1999.

If use of the Website or the Website Content and Services results in the need for servicing or replacing equipment or data, GearLog is not responsible for those costs.
10.5
Subject to Clause 10.1, GearLog will have no liability in contract, tort (including negligence or breach of statutory duty) or otherwise for any indirect or consequential losses, and we shall have no liability for any loss of profit, revenue or opportunity, business interruption, costs of procuring alternative services or for loss of data or damage to any equipment or software which arises in any way from you using or accessing the Website or Website Content and Services or from downloading any material from the Website.

Subject to Clause 10.1, GearLog's total liability in connection with this Website and the use of the Website Content and Services (whether such liability arises under contract, negligence or other tort, breach of statutory duty or otherwise) is limited to an amount equivalent to the fees you have paid to access the Website Content and Services.
